Conflict in the workplace is unavoidable, everyone has experienced it to some degree.
Some conflict can be positive and constructive, if handled appropriately, but without the right process and structure in place it often ends up being damaging and destructive to an organisation. Mediation can be used at any stage in the conflict situation to try and get the working relationship back on track.
When disputes occur, it will almost always result in a stressful and unpleasant working environment for the people involved and colleagues who have to work alongside them. When concerns are not dealt with effectively, they can escalate to much more serious problems such as stress-related absenteeism, grievances and even tribunal claims.
It is estimated that workplace conflict in the UK costs £28.5 billion annually, an average of £1,000 per employee! Around 10 million employees experience conflict in the workplace each year, with more than half reporting stress, anxiety or depression as a result.
The Court of Appeal in Churchill v Merthyr Tydil County Borough Council in November 2023 reiterated the importance of exploring alternative dispute resolution mechanisms whenever possible. No Court or Tribunal will thank the parties for bringing in a case, at the cost of public expenditure, which could have been resolved by taking appropriate, early, alternative steps to litigation.
